Private international law

Jurisdiction. Ley Orgánica del Poder Judicial 6/1985, de 1 de julio 1985, BOE num. 157 de 2 de julio 1985, entrada en vigore el 3 julio 1985, actualizada por la Ley Orgánica 7/2015.

  • Art. 22-quáter (b): jurisdiction of Spanish courts in matters related to the capacity of adults and measures of protection of their person or properties, when they have their habitual residence in Spain.
  • Art. 22-sexies: Spanish jurisdiction for adopting provisional or protective measures with regard to persons or property located in Spanish territory and which must be executed in Spain. They also have jurisdiction for provisional and provisional measures when Spanish court have not jurisdiction on the main proceeding.
  • Art. 22-octies (3) forum necessitatis: Spanish Courts may not abstain from exercising jurisdiction or decline jurisdiction when the dispute is linked with Spain and the courts of different States related to the case have declined jurisdiction.

  • Art. 9, par. 1: applicable law to legal capacity (nationality).
  • Art. 9, par. 6: applicable law to protection measures for vulnerable adults residing in Spain (and for provisional measures) and recognition of foreign measures. The law applicable to the protection of an adult will be determined by the law of his/her habitual residence. In the case of change of residence to another State, the law of the new habitual residence will apply but without prejudice to the recognition in Spain of the measures of protection adopted in other States. However, Spanish law will apply to take urgent and provisional measures of protection.
